Contractor Terms of Service

1. Acceptance of Terms

By claiming a listing, creating a contractor account, or subscribing to any paid tier on AsbestosCheck ("the Service"), you ("the Contractor") agree to be bound by these Contractor Terms of Service ("Terms"). If you are acting on behalf of a company, you confirm you have authority to bind that company.

2. Listing Accuracy & Contractor Obligations

You are responsible for ensuring all information on your listing is accurate, current, and not misleading. This includes:

• Company name, registered address, and contact details
• HSE licence number and licence type (must be valid and current)
• Services offered and geographic areas covered
• Any accreditations, certifications, or memberships claimed

You must update your listing within 14 days of any material change. AsbestosCheck reserves the right to suspend or remove listings that contain inaccurate or outdated information.

3. HSE Licence Requirement

All contractors listed on AsbestosCheck must hold a valid licence from the Health and Safety Executive (HSE) under the Control of Asbestos Regulations 2012, or an equivalent licence where applicable (e.g. HSENI for Northern Ireland). If your licence is revoked, suspended, or expires, you must notify us immediately and your listing will be suspended until valid licensing is restored.

4. Prohibited Content

You must not include in your listing or any communications through the Service:

• False or misleading claims about qualifications, experience, or capabilities
• Guarantees of outcomes that cannot reasonably be assured
• Content that infringes third-party intellectual property rights
• Defamatory statements about other contractors or organisations
• Pricing claims that are not accurate at the time of publication

5. Subscription Billing

Paid subscriptions (Pro, Premium, Enterprise) are billed monthly via Stripe. By subscribing, you authorise recurring charges to your payment method. Prices are shown inclusive of VAT where applicable.

Cancellation: You may cancel at any time through your contractor dashboard or by contacting us. Cancellation takes effect at the end of the current billing period — no refunds are issued for partial months. Upon cancellation, your listing reverts to the free tier.

Data retention on cancellation: Your listing data is retained for 30 days after cancellation to allow for reactivation. After 30 days, premium features (photos, descriptions, priority ranking) are removed and the listing reverts to basic public data sourced from the HSE register.

6. Enquiry Forwarding

AsbestosCheck forwards property owner enquiries to contractors via email. We do not guarantee the volume, quality, or conversion rate of enquiries. You are solely responsible for responding to enquiries and managing client relationships.

7. Data Usage

AsbestosCheck collects and displays contractor data from public sources including the HSE CONIAC register, Companies House, and publicly available business information. By claiming your listing, you consent to AsbestosCheck storing and displaying this data alongside any additional information you provide.

8. Dispute Resolution

Any disputes relating to these Terms shall be governed by English law. We encourage resolution through direct communication before formal proceedings. You may contact us at the email address listed on our website.

9. Limitation of Liability

AsbestosCheck provides a listing and referral platform only. We do not endorse, guarantee, or assume liability for any contractor's work, qualifications, or conduct. To the maximum extent permitted by law, our total liability to you under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim.

AsbestosCheck is not liable for any loss of business, revenue, or profit arising from listing suspension, removal, or service interruption.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email to your registered address at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
